Please read these Terms and Conditions ("Terms") carefully before using [www.finishlinemindset.com] (the "Site") or engaging Finish Line Mindset's services. By accessing the Site or submitting the contact form, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
1. Description of Services
Finish Line Mindset offers two distinct types of services, which are not the same and are governed differently:
a) Licensed Therapy Services — Provided by [Tara Wells, LCSW/Finish Line Mindset LLC], a licensed clinical social worker SW18117, within the scope of their license in Florida, USA. These are clinical mental health services, may include diagnosis and treatment, and are subject to state licensing board regulation, HIPAA, and standard-of-care obligations.
b) Coaching Services — Provided as non-clinical, unlicensed coaching. Coaching is not therapy, counseling, or a substitute for mental health treatment. Coaches are not required to hold a mental health license to provide coaching, coaching is not regulated by state licensing boards, and coaches do not diagnose or treat mental health conditions. Coaching focuses on goal-setting, accountability, and personal development.
You will be informed which type of service you are receiving before beginning services, and separate service agreements/informed consent documents will govern the specific therapy or coaching relationship.
2. No Therapist/Coach-Client Relationship Formed by This Site
Browsing this Site, submitting the contact form, or exchanging preliminary emails does not create a therapist-client, coach-client, or any professional relationship. That relationship begins only upon mutual agreement, completion of intake paperwork, and (for therapy) execution of informed consent documents.
3. Not for Emergencies
This Site and our contact form are not monitored 24/7 and are not intended for emergency use.
If you are experiencing a mental health crisis, having thoughts of harming yourself or others, or facing a medical emergency:

Contact your local crisis service
Do not rely on the contact form, email, or website messaging for urgent or emergency communication.
4. Confidentiality and Its Limits
For therapy clients: Communications are generally confidential under HIPAA and state law, with important exceptions, including but not limited to: suspected child, elder, or dependent adult abuse; imminent risk of serious harm to self or others; court order; or as otherwise required by law. Full confidentiality terms are described in your clinical informed consent.
For coaching clients: Coaching is not protected by the same legal privilege as licensed therapy (no therapist-patient privilege applies). We nonetheless treat your information as confidential and will not share it except as described in our Privacy Policy or as required by law.
5. Telehealth
If services are provided via video, phone, or other remote technology:
Licensed therapy services can generally only be provided to clients physically located in a state where the clinician is licensed. It is the client's responsibility to confirm their location before each session.
Technology may fail or be interrupted; we are not liable for interruptions due to internet, platform, or device issues.
Remote sessions carry inherent privacy/security risks common to electronic communication, even with encrypted platforms.
6. Website Content Is Not Advice
Any articles, blog posts, resources, or general information on this Site are provided for educational and informational purposes only. They do not constitute therapy, coaching, medical advice, or a professional opinion about your specific situation, and should not be relied upon as such. Reading Site content does not create a professional relationship.
7. User Conduct
When using the Site, you agree not to:
Submit false, misleading, or fraudulent information
Attempt to interfere with the Site's security or functionality
Use the Site to transmit harmful code, spam, or unlawful content
Scrape, copy, or misuse Site content beyond personal, non-commercial use
